Indeed, the peculiar apportionment of 1872, adopted in violation of the prevailing law mandating the method of allocating seats, was directly responsible for the 1876 election of Rutherford B. Hayes with a popular vote minority. Had the previous method been followed, even the Electoral Commission would have been unable to place Hayes in the White House.
