Article 212 of the Penal Code (Law No. 38) (2020) criminalises acts of discrimination based on sexual orientation with regard to the provision of goods and services, obstructing economic activities, and access to public or private facilities. In turn, Article 380 punishes incitement to discrimination on the grounds, among other, of sexual orientation. Further, Article 71 establishes that discrimination based on sexual orientation is an aggravating circumstance for the definition of the penalty.
