Prudently, Theodor Tobler and his then company, Tobler AG, applied for a patent in 1909 in Bern to cover the manufacture and shape of the bar, and Toblerone thus became the first patented milk chocolate bar. The official who gave the authorising signature was one Albert Einstein who was working in the Swiss Federal Institute of Intellectual Property in Bern at the time.
