El trabajo fundamental de Waterston fue escrito y presentado a la Royal Society en 1845. La publicación del artículo le es rechazado, pero sin embargo la Royal Society lo retiene y se archiva en sus archivos. El manuscrito fue descubierto en 1891 por Lord Rayleigh, quién procede a criticar al revisor original por no saber reconocer la importancia del trabajo de Waterston. Waterston de todas formas logra publicar sus ideas en 1851, y por lo tanto tiene prioridad sobre Maxwell en enunciar la primera versión del teorema de equipartición.
