"This article explores these questions and argues that Western Sahara has met the legal
criteria for occupation under IHL from early 1976 to the present (2015). It further argues that
certain commercial dealings with Western Saharan resources, from phosphates to fisheries,
are prohibited by the international law of occupation under IHL and attract individual
criminal responsibility as war crimes.'
