While rare, a number of cases in South Korea have emerged where the ordinary courts refused to refer matters to the Constitutional Court for constitutional review. In some of these cases, the statutes in question were eventually struck down after being petitioned directly through constitutional complaint. This indicates that the ordinary courts in South Korea remain hesitant to make referrals for constitutional review, even after the country's transition to democracy in 1987. Though infrequent, such cases underscore the significance of constitutional complaints in allowing individuals or groups to directly challenge the constitutionality of laws without the need for a referral from the ordinary courts.
